Welcome to Pixevo. These terms of service apply to all services offered by Vuurpijl Beheer BV. By using Pixevo, you agree to these terms. Please read them carefully before using our services.

1 Definitions

Pixevo
The AI image generation platform offered by Vuurpijl Beheer BV, located at Lagedijk 11A, 2064 KV Spaarndam, The Netherlands (Chamber of Commerce: 34108141).
User
Any natural or legal person who creates an account and uses the Service.
Service
The functionalities offered through Pixevo for generating images and videos using artificial intelligence.
Credits
The virtual currency within Pixevo with which Users can perform generations. Credits are non-transferable and cannot be exchanged for money.
Content
All images, videos and other media generated by the User using the Service.
AI Models
The third-party artificial intelligence models made available through Pixevo for generating Content.

2 Applicability

2.1 These terms of service apply to all agreements between Pixevo and the User regarding the use of the Service.

2.2 By creating an account or using the Service, the User declares to have read, understood and accepted these terms.

2.3 Pixevo reserves the right to modify these terms. Changes will be announced at least 30 days in advance via email or the website.

2.4 In addition to these terms, the terms of the AI models used (such as Nano Banana Pro, Flux, and others) also apply to the use of those specific models.

3 Account and Age

3.1 To use the Service, the User must create an account with a valid email address.

3.2 The User must be at least 18 years old to create an account and use the Service.

3.3 The User is responsible for keeping login credentials secret and for all activities that take place through their account.

3.4 Accounts are strictly personal and may not be transferred, sold or shared with third parties.

3.5 Pixevo reserves the right to refuse, suspend or terminate accounts in case of violation of these terms.

4 Credits and Payments

4.1 The Service operates with a credit system. Credits can be purchased through one-time purchases or monthly subscriptions.

4.2 Credits are non-transferable between accounts and cannot be exchanged for money.

4.3 Right of withdrawal: When purchasing credits or subscriptions, a statutory 14-day right of withdrawal applies in principle. By explicitly consenting to immediate delivery of the digital content (via the checkbox at purchase) and acknowledging that delivery begins immediately, the User waives this right of withdrawal in accordance with article 6:230p sub e of the Dutch Civil Code. Without this explicit consent, credits are only activated after 14 days.

4.4 Prices include VAT unless otherwise stated. Pixevo reserves the right to change prices with prior notice.

4.5 For failed generations due to technical errors on Pixevo's side, the credits used are automatically refunded.

4.6 Unused credits from subscriptions do not expire and remain available as long as the account is active.

5 Ownership of Content

5.1 The User retains full ownership and all rights to the Content they generate.

5.2 The User may freely use the generated Content, including for commercial purposes, unless this conflicts with the terms of the AI model used.

5.3 Pixevo claims no ownership rights to Content generated by Users and will not use it for promotion or other purposes without explicit consent.

5.4 The User is responsible for complying with third-party intellectual property rights when using the generated Content.

6 Prohibited Use

6.1 The User may not use the Service to generate content that violates Dutch or European legislation.

6.2 It is expressly prohibited to generate content that: (a) contains or suggests child abuse or exploitation; (b) glorifies terrorism or incites violence; (c) contains discrimination or hate speech; (d) involves deepfakes of real persons without their consent; (e) infringes on copyrights or other intellectual property rights; (f) contains personal data of others (doxing); (g) facilitates fraud, scams or deception.

6.3 The User must also comply with the legislation applicable in the country where the generated content is used or published.

6.4 NSFW content (adult content) is permitted within the limits of the law and the restrictions of the AI model used. Not all AI models support this type of content.

6.5 Pixevo reserves the right to remove content and terminate accounts in case of violation of this article, without refund of credits.

7 AI Models and External Terms

7.1 Pixevo provides access to various third-party AI models. Each model may have its own terms and restrictions.

7.2 By using a specific AI model, the User also agrees to the terms of that model.

7.3 Some AI models may have restrictions on the type of content that can be generated. These restrictions are displayed in the interface where possible.

7.4 Pixevo is not liable for changes in the availability or functionality of third-party AI models.

7.5 User uploads are not used for training AI models, unless the specific terms of a model explicitly state this and the User consents to it.

7.6 Transparency (EU AI Act): All content generated via Pixevo is artificially generated using AI. The User is responsible for complying with transparency requirements when publishing AI-generated content, including the obligation to clearly label deepfakes and synthetic media in accordance with article 50 of the EU AI Regulation.

8 Storage and Retention

8.1 Generated Content is stored on servers within the European Union.

8.2 The retention period of Content depends on the subscription and the available storage space of the User.

8.3 When the storage limit is reached, older Content may be automatically deleted. Users will be notified in advance.

8.4 After termination of an account, Content is permanently deleted within 30 days, unless legal retention obligations require otherwise.

8.5 The User is responsible for making backups of important Content.

9 Liability

9.1 Pixevo endeavors to make the Service function as well as possible, but cannot guarantee uninterrupted or error-free operation.

9.2 Pixevo is not liable for any damage resulting from the use of the Service, unless there is intent or gross negligence on the part of Pixevo.

9.3 If Pixevo is held liable despite the foregoing, this liability is limited to the amount the User has paid to Pixevo in the 12 months prior to the damage-causing event.

9.4 Pixevo is not liable for indirect damage, consequential damage, lost profits or missed savings.

9.5 The User indemnifies Pixevo against all claims from third parties arising from the User's use of the Service, including but not limited to claims regarding intellectual property and privacy violations.

10 Availability, Maintenance and Force Majeure

10.1 Pixevo aims for 99% availability, but does not guarantee specific uptime.

10.2 Pixevo may temporarily interrupt the Service for maintenance, updates or improvements. Planned interruptions are announced in advance where possible.

10.3 Pixevo reserves the right to add, modify or remove functionalities.

10.4 Force Majeure: Pixevo is not liable for failure to perform or delayed performance of obligations if this is due to force majeure. Force majeure includes: disruptions at hosting providers or AI model providers, cyber attacks, natural disasters, government measures, strikes, pandemics and other circumstances beyond Pixevo's reasonable control. In case of force majeure lasting more than 60 days, the agreement may be dissolved by either party without compensation.

11 Termination

11.1 The User may terminate their account at any time through the account settings.

11.2 Upon termination by the User, no refund of unused credits will be made.

11.3 Pixevo may terminate an account with immediate effect in case of serious violations of these terms.

11.4 After termination, Pixevo retains the right to keep certain data if this is legally required.

12 Applicable Law and Disputes

12.1 These terms and all agreements between Pixevo and the User are governed by Dutch law.

12.2 Disputes will be submitted to the competent court in the Noord-Holland district, Haarlem location.

12.3 Consumers may also use the European Online Dispute Resolution platform (ODR) at ec.europa.eu/consumers/odr.

12.4 If any provision of these terms is found to be void or voidable, this does not affect the validity of the remaining provisions.
